1. These terms
These terms are an agreement between the business that uses GrowHigh ("you") and Winni Pet Care LLP, which operates GrowHigh ("GrowHigh", "we", "us"). By signing an order with us, creating an account or using GrowHigh, you agree to them on behalf of your business. If you and we have signed a separate written agreement, that agreement takes priority where the two differ.
2. The service
GrowHigh includes the web app, the mobile app, AI features, connections to other services, the developer and partner consoles and the GrowHigh Marketplace. We improve GrowHigh continuously and may change features. If we remove a feature your business relies on, we will tell you in advance wherever we reasonably can.
3. Accounts and users
- Your admins decide who uses GrowHigh, with which role, and can remove access at any time. You are responsible for what happens under your users' logins.
- Keep passwords and keys secret, turn on the security options that suit you, and tell us at once if you suspect anyone has used your account without permission.
- Users must be at least 18 and act for your business.
4. Your data
- Your customer data stays yours. You give us permission to process it only to provide, secure and support GrowHigh for you, as described in our Privacy Policy.
- You are responsible for having the right to collect the data you put into GrowHigh and to contact the people in it, including any consent the law requires.
- You can export your data while your account is open. After your account closes, data is deleted or anonymised within 90 days, as the Privacy Policy describes.
5. Acceptable use
You agree not to use GrowHigh to:
- Send spam, or message or call people who have not agreed to hear from you or who have opted out.
- Break the rules of the channels you connect, such as the WhatsApp Business and Meta platform policies, or telecom rules on commercial calls and messages, including registration and do-not-disturb preferences.
- Store or send unlawful, misleading or harmful content, or infringe anyone's rights.
- Try to break into, overload, copy or reverse engineer GrowHigh, get around its security or limits, or access another business's data.
- Resell GrowHigh, unless you are a GrowHigh partner acting under a partner agreement.
We may remove content or limit an account that breaks these rules, and will tell you why unless the law prevents it.
6. Other services and Marketplace apps
- WhatsApp, Meta, Google, calling and email providers, AI assistants and other services you connect are governed by their own terms. We are not responsible for them, and their availability can change.
- Apps in the GrowHigh Marketplace are made by GrowHigh or by other developers. When your admin installs an app, the data your admin approved is shared with that app's developer, whose own terms and privacy policy apply.
- Apps marked "Preview" or "Coming soon" are not finished and may not work yet.
7. AI features
AI features help your team, but their answers, summaries and suggestions can be incomplete or wrong. Review AI output before you rely on it, especially before you send it to a customer or use it for a decision. Where GrowHigh offers an approval step before an AI action changes a record or contacts a customer, you choose who approves.
8. Fees
Fees and payment terms are those agreed with you in writing before you start, for example in an order or plan. Taxes such as GST are added where they apply. If an invoice stays unpaid after reminders, we may limit or suspend the service after giving you notice.
9. Confidentiality
Each of us keeps the other's non-public information confidential and uses it only for the purpose of this agreement, except where the law requires disclosure.
10. Availability and support
We work to keep GrowHigh available and secure, and to fix problems quickly. We sometimes need planned maintenance, and we try to schedule it outside working hours. Unless we have agreed a service level with you in writing, we do not promise uninterrupted availability.
11. Suspension and ending
- You can stop using GrowHigh as your plan allows.
- We may suspend an account, an app or a user straight away if there is a security risk, a serious breach of these terms, or a legal requirement, and will tell you what happened.
- Either side may end this agreement if the other seriously breaks it and does not fix the problem within 30 days of being told.
12. Intellectual property
GrowHigh, its software, design and content belong to us or our licensors. These terms give you the right to use GrowHigh for your business while your account is active, and nothing more. If you send us ideas or feedback, we may use them without obligation to you.
13. Warranties
We provide GrowHigh with reasonable skill and care. Apart from that, and to the extent the law allows, GrowHigh is provided "as is", without other warranties, express or implied.
14. Limitation of liability
To the extent the law allows, neither of us is liable for indirect or consequential losses, such as lost profits, revenue or data, and our total liability under this agreement is limited to the fees you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
15. Indemnity
You will cover our reasonable losses from a claim by someone else arising from the data you put into GrowHigh or the messages and calls you send through it in breach of the law or these terms.
16. Developers and partners
- If you use the developer or partner console, these terms apply together with the requirements shown in the console, such as app review, approved permissions, security rules and rate limits.
- Keep keys and client secrets confidential and on your servers. Use a company's data only for the purpose its admin approved, and only while your app or partner access is active.
- We may pause or remove an app or partner access that puts companies or their customers at risk.
17. Governing law
These terms are governed by the laws of India. Courts in India with jurisdiction over our registered office have exclusive jurisdiction over any dispute, unless we agree otherwise in writing.
18. Changes to these terms
We may update these terms. We will revise the "Last updated" date above, and tell you in advance about material changes, inside the product or by email. If you keep using GrowHigh after a change takes effect, the new terms apply.
